1. Scope

The General Terms and Conditions (GTC) of IschiaHomeStays (hereinafter referred to as “IschiaHomeStays”) are an integral part of the reservation confirmation between you as the “tenant” and us as the agent on behalf of the property owner.

2. Booking a holiday rental property from IschiaHomeStays

2.1 With the booking of a holiday property in written form, by mail or online, you conclude a binding rental agreement with IschiaHomeStays as an agent. With the sending of our electronic reservation confirmation, rights and obligations according to our GTC become legally valid.

2.2 We reserve the right to correct obvious errors, e.g. printing and calculation errors. Special requests, bookings under a condition and verbal agreements are only valid if they are confirmed by us in writing. The basic night rate always includes utilities costs unless specified.

2.3 Upon reservation, the tenant has to inform us about the number of adults and children (0 to 2 year and 3 to 10 years) when booking. According to the indicated number of persons, the accommodation and beds will be prepared. Overcrowding is not allowed. The rental property may not be sublet. Non-compliance entitles IschiaHomeStays for the immediate withdrawal of the keys of the rental property without compensation during the booked period.

3. Payments of rental price and local taxes

3.1 Payment by credit card: Payment at the time of booking (conclusion of the contract) is 100% of the rental price (total amount for overnight stays plus cleaning fee).

3.2 Payment by bank transfer: In agreement, payment can be made by electronic invoice and bank transfer. Payment at the time of booking (conclusion of the contract) is 100% of the total rental price and cleaning fee.

3.3 The validity of the contract comes into force only with the confirmation of the advance payment made to IschiaHomeStays. The advance payment must be transferred within 24 hours of the booking, otherwise the reservation becomes void and IschiaHomeStays has the right to cancel the reservation without substitution.

3.4 Payments to IschiaHomeStays, shall be made in full and without any deduction of expenses and bank charges.

3.5 Tourist/Local taxes; are to be paid on the day of arrival at the property and in cash to the property owner/representative. Ischia current visitor’s tax is of 2 Euro per person per night stay. Children under 12 are exempt.

4. Cancellation and insurance

4.1. A 100% refund of the paid amount in the event of cancellation within 48 hours from booking time.

The free cancellation within 48 hours can be made by either side, on the part of the tenant as well as on the part of IschiaHomeStays.

4.2 In case of a cancellation after 48 hours a handling fee charge applies as well as the following cancellation costs:

– up to days 45 before the start of the rental period: only handling fee charges. The handling fee is 50 Euro plus 3% fee on the total booking amount.

– from 44 to 30 days before the start of the rental period: 50% of the full rental cost-plus handling fee

– from 29 days before the start of the rental period: 100% of the rental price

4.3 In case of cancellation, the paid and unclaimed cleaning fees will be refunded to the tenant.

4.4 In case of non-arrival, the tenant shall pay an amount equal to the total amount of the rental booking.

If the agreed rental period is not fully utilised, the full rental price for the agreed period shall nevertheless be paid.

4.5 We recommend to the tenant the need to contract a valid travel cancellation insurance.

5. Damage to property and content
   
   

   5.1 Any damage to the property or content occurred during the rental period will be charged to the tenant.

   5.2 Equipment, content and property must be treated with respect and care. The house rules must be observed.

   Any damage or loss caused by the tenant or fellow tenants must be reported to IschiaHomeStays immediately and compensation for damage made.

   5.3 Any damage that was is not reported to us, as well as any subsequent cleaning of a heavily soiled objects will be charged to the tenant. The burden of proof that the damage is not the fault of the tenant is not accountable to IschiaHomeStays

6. Arrival, stay and departure

6.1 Approximately 3 – 4 days before arrival the tenant will receive information for check-in.

The tenant must notify the arrival times to enable the property keys handover which will take place at the rental property.

6.2 Check-in at the rented property is allowed from 15.00 local time.

The rental property is handed over in a clean and functional condition. If there are any defects or issues, the tenant should contact IschiaHomeStays so that remedial action can be taken as soon as possible.

6.3 IschiaHomeStays assumes no responsibility and no liability in case of accidents at the property

6.4 The tenant has the right to use the rented property, including content and utensils. The tenant is responsible for the safe keeping of all that belongs to the rental property.

6.5 Pets (except by prior arrangement), smoking and parties are not allowed at the rental property.

6.6 The tenant is required to keep the property in a clean and tidy order and to leave the property in a state of cleanliness on the day of departure. Dishes and pots must be washed, any moved furnishings must be relocated to the same place, refrigerator and cupboards emptied, waste bags or empties disposed of. Only prescribed waste/recycling bags may be used.

6.5 The rented property must be vacated by no later than 11:00 local time on the day of departure.

The keys are to be handed back to the property owner unless arrangements are made otherwise. Any lost keys will be charged to the tenant.

7. Internet

7.1 All IschiaHomeStays properties are equipped with free WiFi. The access code can be found at the rental property. The code is intended exclusively for the personal use of the tenant.

IschiaHomeStays has no control on the WIFI speed performance and signal strenght.

7.2 The WLAN exclusively enables access to the Internet but does not include any virus protection or firewall. The transmission of data is not encrypted.

7.3 The tenant is expressly prohibited from using the WLAN for uploading data, files, videos, etc. or for any other dissemination of illegal, immoral, racist or copyrighted content, for incitement to crime or manipulation of software and hardware as well as devices and equipment of any kind. The sending of SPAM etc. is prohibited.

8. Liability and change of services

8.1 In the event that IschiaHomeStays withdraws from a property contract before the start of the trip (because of force majeure such as war, strike or damage to the rental property due to accidents, fire and water damage and similar compelling reasons), all amounts paid will be refunded immediately. Further claims are expressly excluded.

8.2 No liability can be accepted by IschiaHomeStays for disruptions to the  execution of the rental agreement whose cause lies outside its sphere of influence, in particular in the event of war, strikes, natural disasters, etc., as well as for disruptions to services in the area of transport,  utilities and disposal (e.g. water, energy, access routes), in particular if these disruptions are due to force majeure or local climatic conditions and  in the event that transport service is interrupted  between the island and the mainland with or without notice.

IschiaHomeStays reserves the right to cancel bookings without notice in the event of damages to the property or where there is a risk of injury to the renter. In this case all amounts paid will be re-imbursed immediately.

8.3 IschiaHomeStays does not assume any liability towards the renter during the rental period.

9. Jurisdiction and choice of law

All disputes arising from the rental relationship between the tenant and IschiaHomeStays shall be subject to Italian law.
